Integration and amendment of general terms and conditions
These AGB govern the contractual relationship entered into between Olesia Incarbone and the customer. The customer has read these AGB and confirmed their acceptance. Subsequent amendments or additions to these AGB will be published on this homepage. They shall become part of the contract if the customer does not object within 30 days of becoming aware of the amended AGB.
Scope and subject matter of the General Terms and Conditions
The AGB cover all services of the activities provided by Olesia Incarbone in Switzerland and abroad, in particular classes, private sessions, corporate sessions, events, retreats, e-shop as well as contracts not mentioned which are related to the aforementioned business activities. Should individual provisions be or become invalid, the remaining provisions shall remain valid. By using one or more offers or orders, the participant agrees to the application of these AGB.
Olesia Incarbone primarily provides fee-based services. The AGBs apply to every service that is booked in any way (via booking platform, email, telephone, internet, mobile phone, etc.). A customer is any natural or legal person who purchases activities from the provider or has registered for such services. By using one or more services, the customer irrevocably agrees to the application of these AGB.
The following General Terms and Conditions shall be deemed to have been agreed for the performance of all activities or services via Olesia Incarbone. These terms and conditions shall be deemed binding and accepted by the customer at the latest upon binding registration.
Personal responsibility
For all classes, private sessions, corporate sessions, events and retreats taught and organised by Olesia Incarbone, self-responsibility and normal mental and physical resilience and fitness are assumed. Yoga classes or Breath Work sessions do not constitute medical or psychotherapeutic treatment. Olesia Incarbone must be informed of any existing health restrictions or pregnancy at the beginning of a class at the latest. Olesia Incarbone must be informed immediately should a health restriction occur in the course of the session. All participants take part in these courses on their own responsibility, so that it is also at the discretion of the respective participant to seek medical advice before participating in courses and private sessions and retreats. The provider reserves the right to refuse customers if there are indications that the customer does not fulfil the health and psychological requirements for participation in a course or event. This refusal can also be made at short notice or during an ongoing activity.
Reservations
Online bookings can be made via this homepage or via Olesia Incarbone. If the class is full, the customer will be placed on a waiting list. The booking through the waiting list is binding. It makes sense for the customer to be there at least 15 minutes before the start of the class. Olesia Incarbone reserves the right to cancel a class, even at short notice, especially in the event of illness or unforeseen circumstances, or to have a suitably qualified person replace the class. The customer will be informed as soon as possible by e-mail, SMS or telephone of any cancellation (with the exception of unforeseeable cancellations).
Eligibility / Liability
It is the responsibility of the participants to consult their doctor before the start of the first class or private session as to whether yoga may be practised. Any existing mental or physical health restrictions, as well as an existing pregnancy, must be reported to Olesia Incarbone at the latest at the beginning of the event. Insurance is the sole responsibility of the participant, any liability is rejected. No liability is accepted for any valuables brought along by participants.
Cancellation conditions
Registrations for classes, private sessions, events and retreats are binding. The costs are due even in the event of a no-show. It is possible to find a replacement person in advance: The replacement person must be notified by email, stating their surname/first name and email address. A refund of part or all of the costs will only be made in the event of illness or accident on presentation of a medical certificate before the start of the programme.
Cancellations are associated with administrative effort and must be communicated to the provider.
Retreats
Registration / Deposit / Final payment
Upon receipt of the registration, the participant will receive a confirmation of registration together with the bank details for payment of the retreat. The total amount of the trip is due upon registration. The place on the retreat is only definitively reserved once the full amount has been paid. Registration is binding and requires payment of the full amount. Non-payment does not constitute cancellation. If payment is not made on time, the travel services can be refused and cancellation costs can be claimed. If the number of participants is limited, registrations will be considered in the order in which they are received. The date of receipt of the bank transfer shall apply.
Cancellation
In the event of cancellation up to 90 days before the start of the retreat, the total amount minus 10% expenses will be refunded. Up to 40 days before the start of the retreat, 50% of the total amount will be refunded. In the event of cancellation at a later date, a refund of the total costs is excluded. The vacant place can be transferred to another person. In this case, a processing fee and any rebooking costs may be charged.
Changes
We expressly reserve the right to make changes to the programme and specific services (programme, accommodation, supervision, transport) due to unforeseeable circumstances or safety reasons. In this case, any additional costs shall be borne by the participants.
Cancellation of the trip by the participant
If the participant cancels the trip prematurely for any reason, the price will not be refunded. Any additional costs shall be borne by the participant.
Trip cancellation by the provider
We reserve the right to cancel a trip at short notice due to force majeure, official measures, strikes or illness of the teacher. A trip can also be cancelled up to 20 days before departure if the minimum number of participants is not reached. In this case, the amount paid will be refunded in full. No further claims can be made.
Travelling and entry formalities abroad
The outward and return journey to the destination is the responsibility of the participants and the resulting costs are not included in the offer. It is the participant's responsibility to comply with the entry regulations abroad. Passports or identity cards must be valid at least until the date of return, and in some countries for at least 6 months beyond the date of return. The provider accepts no liability for non-compliance with regulations and associated expenses, e.g. in the event of denied entry.
Insurance
Insurance is the responsibility of the participant in every respect. The organiser cannot be held liable for theft or loss of items. Participants are advised to take out the following insurances: Travel cancellation insurance, health and accident insurance.
Health requirements
Good health and a stable mental condition are required for the retreats. The participant takes part on his/her own responsibility and undertakes to inform the provider of any physical and/or mental impairments. If necessary, the advice of a doctor must be sought before participation. If a participant does not fulfil the physical or mental requirements, the provider may exclude the participant from the (onward) journey. Return travel costs etc. shall be borne by the participant and the amount paid cannot be refunded.

In particular, they do not constitute an assurance of properties or guarantees, unless explicitly stated otherwise. Olesia Incarbone endeavours to ensure that all data and information on this website is correct, complete, up-to-date and clear, but Olesia Incarbone cannot provide any express or implied warranty in this respect. Olesia Incarbone cannot guarantee that the products listed will be available at the time of ordering. Therefore, all information on availability and delivery times is subject to change at any time and without notice.
Prices
The sales prices stated on this website are final prices and, unless otherwise stated, include VAT and any other statutory charges. The prices are quoted net in Swiss francs (CHF).
Unless otherwise stated, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the order process.
Olesia Incarbone reserves the right to make technical changes, errors and misprints, and in particular to change prices at any time and without prior notice.
Conclusion of contract
The products and prices on this website are non-binding offers.
By placing an order via this website, the customer submits a legally binding offer to conclude a contract, including acceptance of these AGB. Olesia Incarbone then sends an order confirmation by email, which confirms that the customer's offer has been received. Orders placed are binding for the customer. There is no right of return or cancellation.
The contract is concluded as soon as Olesia Incarbone sends a declaration of acceptance by email confirming receipt of the order.
Orders will only be dispatched once payment has been received in full. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, Olesia Incarbone shall be entitled not to accept or only partially accept or fulfil the order. In such a case, Olesia Incarbone will inform the customer by e-mail or telephone. If the customer's payment has already been received, the payment will be refunded to the customer. If no payment has yet been made, the customer shall be released from the obligation to pay.
Payment options and retention of title
The customer may use the payment options specified in the order process. The products delivered to the customer remain the property of Olesia Incarbone until full payment has been received.
Delivery, returns and warranty
Deliveries are sent by Swiss Post or courier service to the address specified by the customer in the order. However, Olesia Incarbone's delivery deadlines stated in the order confirmation or on the product pages are non-binding. Olesia Incarbone is authorised to make partial deliveries. In this case, the shipping costs will only be charged to the customer once.
If the delivery cannot be delivered or if the customer refuses to accept the delivery, Olesia Incarbone may cancel the contract after notifying the customer by e-mail and granting a reasonable grace period, and may charge the customer for the costs incurred.
In principle, ordered items cannot be returned. Olesia Incarbone endeavours to deliver goods of impeccable quality. If the goods have been demonstrably damaged before receipt by the customer, Olesia Incarbone will replace the purchased product (in the case of defects notified in good time within 14 days of receipt of the goods). The customer is obliged to inspect the delivered goods immediately upon receipt and to report any defects without delay. In this case, the customer must contact Olesia Incarbone (by e-mail or telephone).
It is at the discretion of Olesia Incarbone to fulfil the warranty by repairing the product free of charge, replacing it with an equivalent product or refunding the purchase price. Further warranty rights are excluded.
The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or defects attributable to external circumstances.
Copyright
The copyright and all other rights to content, images, photos or other files on the website and other media belong exclusively to the provider. The written consent of the copyright holder must be obtained in advance for the reproduction of the elements. Offences will be prosecuted and will result in compensation for damages. Some of the images on the homepage come from free image portals and can be legally used for this homepage, e.g. from Unsplash. These images may continue to be used.
Disclaimer
Olesia Incarbone is obliged to provide the booked services to the customer with due care. Olesia Incarbone shall only be liable for damages caused by Olesia Incarbone intentionally or through gross negligence in the event of a breach of this obligation. Any further liability is excluded to the extent permitted by law. Moreover, liability shall in any case only exist if the customer has given Olesia Incarbone sufficient opportunity to remedy the damage or its cause. Olesia Incarbone shall not be liable for force majeure. Force majeure includes all unforeseeable events as well as events whose effects on the fulfilment of the contract are not the responsibility of either party. Olesia Incarbone shall not be liable for any booked services provided by third parties. Olesia Incarbone shall not be liable for consequential damages such as loss of business, loss of profits, loss of expected savings, loss of data, damages/claims of third parties and other consequential damages. The customer is advised to take out appropriate insurance.
